Terms and Conditions
Last updated: 28 October 2026 · This is a translation; the German version prevails.
1. Scope and provider
These terms apply to the purchase of software licences (full versions of the Temia programs) via the website temia.de. The provider is: Temia Consulting, owner Vladimir Romanov, Rosenheimer Str. 83, 81667 Munich, Germany, e-mail: contact@temia.de.
Deviating terms of the buyer do not apply. Custom software development, cloud hosting and the Temia Business Portal are governed by separately agreed terms.
2. Purchases through resellers
Some programs are also sold through resellers, for example the Apple App Store, Digistore24 or Paddle. In these cases the reseller is your contractual partner and seller (Merchant of Record). The reseller handles the order, payment, invoice, sales tax, cancellation and refunds, and its buyer terms apply in addition. Sections 6 to 9 of these terms apply to the use of the software.
3. Conclusion of contract
The presentation of the programs on temia.de is not a binding offer. By submitting the order form you make a binding offer to purchase. The contract is concluded when we confirm the order by e-mail or send you the download link or licence key.
4. Prices and payment
All prices are final prices including statutory VAT. There are no shipping costs, as the programs are delivered as downloads. Payment is made using the methods offered in the order form.
5. Delivery
After receipt of payment you will receive a download link and/or a licence key by e-mail, usually within one working day. Licence keys are redeemed at temia.de/en/key.html, after which you receive the download link of the full version. If a link no longer works, we will send a new one on request.
6. Licence
With the purchase you receive a simple, non-exclusive and perpetual right to use the purchased program version as described in the product description. Unless the product description states otherwise, one licence covers one user.
Licence keys may not be passed on to third parties, published or rented out. The program may only be modified, decompiled or reverse-engineered where permitted by law. There is no entitlement to future major versions unless expressly agreed; statutory update obligations (section 8) remain unaffected.
7. Trial version
For most programs a free trial version (demo) is available that can be used for 30 days. Please use it before buying to check that the program runs on your system and meets your requirements.
8. Warranty
Statutory warranty rights apply. For consumers, the statutory provisions on digital products apply, including the statutory obligation to provide updates. For business customers, warranty claims expire one year after delivery.
9. Liability
We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee given. In cases of slight negligence we are only liable for breach of essential contractual obligations, limited to the typical, foreseeable damage. For loss of data we are only liable for the effort that would have been necessary to restore the data if the buyer had made regular backups.
10. Right of withdrawal and refunds
Consumers have a statutory right of withdrawal. Details are given in our Refund Policy.
11. Dispute resolution
We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board. If you have any questions or problems, please write to contact@temia.de.
12. Final provisions
The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods. For consumers this choice of law applies only insofar as it does not deprive them of the protection of mandatory provisions of the country of their habitual residence. If the buyer is a merchant, the place of jurisdiction is Munich. Should any provision of these terms be invalid, the validity of the remaining provisions shall not be affected.
